ANPR Parking notice

Hi All
I have just received in the post a parking charge notice from Britannia Parking with my full name and address which I presume they have got from the DVLA plus images of my car reg. I have prepared my letter of response as the keeper of the vehicle re the notice being dated 14 days after the breach, but I have also heard that if Britannia contacted the DVLA within the 14 day period after the alleged breach, then they legally have up to 6 months after the breach date to enforce the penalty legally.
Can anyone help please with advise before I send my letter off, or is this an enforceable fine?
Thank you in advance
Max

You aren't sending off a letter in the post - see the NEWBIES thread.
If you've written it as the driver, tear it up and use the sticky thread template.
If the PCN was dated more than 14 days after the event it cannot have been received in time to hold you liable as keeper - so be the keeper in the appeal...
You'd win at POPLA as long as no words blab about who parked.
Slightly different advice applies if this is a company/lease/rental car but that's also explained lower down the first post of the NEWBIES thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It is the will of Parliament that these scammers, (very often former clampers), be put out of business.
Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers. You never know how far you can go until you go too far.0 -
Thank you Coupon-mad
I tried to read through the sticky threads but got a bit lost regarding the point about the DVLA..Below is the letter I have prepared from a template - is it ok?
Dear Sirs
Dear Sirs
I am the keeper of vehicle .......... and have received your parking charge notice.
Your notice is dated 14 days after the alleged breach. It cannot, therefore, be delivered within the relevant period of 14 days as required by Schedule 4 of the Protection of Freedoms Act 2012. Because of this failure, and others, I, as the registered keeper, cannot be held liable for the actions of the driver. There is no legal requirement for me to identify the driver at the time and I will not be doing so.
I do not expect to hear from you again other than to confirm that no further action will be taken against me and my details have been removed from your file.'
The notice was dated 20 December, it was dated 10th Jan and postmarked 15 Jan.
Many thanks for your advise .

Why did your vehicle receive a parking charge notice, and in whose car park was this? From the Plain Language Commission:

All good, except do not put it in the post, and change the ''I'' followed by a comma, which is not English and drives me up the wall!maxinerawji wrote: »Thank you Coupon-mad

If Britannia have an electronic appeals portal, use that. Check there are no drop down boxes that default to driver, or change back to driver if you click or scroll elsewhere on the page.
Take screenshots before you submit it to prove you haven't selected driver.I married my cousin. I had to...I don't have a sister.

Hi Fruitcake
The keeper has heard that neither the manager nor the CEO is interested in these types of cases as they are responsible for employing Britannia in the first place sadly.
