Napier parking

I recieved a letter from BW Legal following a parking ticket on an ANPR system in Milton Keynes.
We took both cars to Willen Lake as I was going straight to work. I paid my wife's ticket then as I was about to pay my ticket my sons friend ran over said don't pay, charlie(my son aged 12) has paid it on his go Henry card and gave me a white ticket. I left the car park and on my way I got a txt from go Henry to say there was not enough money on my sons card so had been declined. It was a bank holiday weekend, so I rang Napier parking on the Tuesday explained the situation, offered to pay over the phone to be told no you'll get a PCN and you will have to appeal it. The PCN arrived, I appealed and lost and now I have BW Legal chasing me. Could you guys advise me please. TIA

That's the same as all other BW Legal threads about claims from any PPC, and there are a few Napier ones on here too.
There's no need for individual advice until claim/defence stage, as LBC stage (if you just have a LBC) is fully covered in post #2 of the NEWBIES thread.
Come back when you've got your SAR.
HOWEVER, in the SAR, make sure you ask Napier for:
- the VRN data from the PDT machine and the record of the attempted card payment record (but do NOT say it wasn't your card, nor a child's card) and
- the recorded phone call that they said they took, when you phoned on xx/xx/18 and explained the card had failed and you wanted to pay the tariff in good faith, including their operative's reply.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Unfortunately Napier have victories in court at this very car park so they have a history of doing court. If it did come to court, I would seriously weigh up settling -v- fighting it.
But keep all your correspondence to show you were being reasonable. And it's the Parks Trust that owns the land, so you could explain to them.0 -
Thanks guys. It is very much a rock and hard place but believe I have made every effort to pay and my son was doing what he thought was the right thing to do. I will contact Go Henry for the transaction proof to help my case. Thanks again0

But NOT now they use BW Legal. Napier are as bad as all the rest now they don't orchestrate their own court cases, and this will be a badly-run typical BW Legal case.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
