3D Parking NTK

Good evening,

This is my first post on MSE but have used the extremely helpful info on here to clear 5 PCNs in the past (the wife is a wonky parker and double dipper :rotfl: ) and also one LBC from Gladstones seen off. So kudos and thanks to everyone who posts and reply's on these forums.

My latest quest for justice is for my daughter who has been "invoiced" by 3D parking (IPC member) on her work estate. to save time and money and presumably to keep a low profile and alerting other users to their money making activities they have sent a NTK directly to my daughter (within fourteen days) but without a windscreen ticket. The estate is clearly not ANPR and photos are obviously from a handheld camera, so my are they acting outside POFA and voiding the keeper liability in one swoop? No mention of POFA anywhere on their invoice. Have searched this point in the forums but can not find anything related.

    No.

    No-one stops them doing this, even though the right (and 14 day deadline) to serve PCNs by post was wholly intended to address ANPR systems, when Parliament added it to the POFA. Some of us followed the POFA Bill as it went through parliament in 2012, so we know the amendments that were made to Schedule 4 and why they were made.

    But if you give a parking scammer an inch they will take a mile, and no-one stops them.
    No mention of POFA anywhere on their invoice.
    Why do you think it has to mention the POFA? If they want to try to hold your DD liable as registered keeper, they don't have to ''mention the POFA'' but they would have to include all the statutory wording in paragraph 9 of Schedule 4.

    e.g. the 'keeper liability' 28/29 days warning in 9(2)f is clearly vital to be stated pretty much verbatim.

    Does the PCN state the time, in the first lines where it talks about the location & date?

    ...which part were you interpreting to meet 9(2)f of Schedule 4? I saw nothing to tell me that the keeper could be liable, did you?

    You are correct Coupon - mad, your knowledge on here is invaluable and I am grateful for your time and assistance.

    I read the "passing to the debt collectors after 28 days" as meaning they were holding the keeper liable (which is undoubtedly their botched intention). But as you wisely stated they have not stated the keeper will be liable for the bogus invoice :)
