Confused re PIP

Hi all my husband has been in receipt of PIP standard dailty living since its introduction, this was due to be reviewed in May 2019 and i received all the paper work in May 18

I completed the forms for him and also informed them of a recent change in his current state of health.

I provided alot of evidence from all the relevent medical professionals including a full psychiatrist report and its findings, required tretment long term prognosis etc..

It took until December for his new award to be made but he did carry on receiving the standard rate daily living as per the existing award from 2015.

When his award letter arrived he was awarded a futher 4 years at standard rate daily living but also awarded standard mobility and was paid the arrears in full back to May 18 th 2018.

His circumstances are such that mobility is a major factor in his ongoing health issues and his abilities are further reduced by his poor mental health which he has had for many years.

I have the following questions and need advice before i decide what to do as it causes him much distress.

I submitted a MR the day after his new award came has they had totally disregarded his mental health and all the descriptors which were answered in full and backed up with all the medical evidence. Infact we tried for a home visit but was advised he must attend so we did.

At the assesment he was very uncomfortable and we actually toook all the evidence with us and hand wrote bullet points highlighting in detail our answers for each descriptor. She declined to accept this and pressed my husband to answer questions which he tried his very best to do. On receiving the award and the report all the mental health indicators are dismissed or ignored entirely she even stated he was comfortable at the assesment even though he clearly wasnt.

I had already contacted our MP due to the stress and upset the process causes and they helped get his award sorted

I have the results of the MR today and he has been awarded enhanced rate mobility but only received 6 weeks back pay and not back to May when the new award runs from. I dont know what to do i also feel his Daily living award should also have been awarded at the enhanced rate and am considering submitting an appeal which our MP has agreed to support due to the overwhelming evidence provided and a long medical history to support this

Sorry for the really long post my Question is in relation to the Back payment of the arrears i was of the understanding it should be back dated to May but hes received less than 6 weeks and the MR Desicion Letter doesnt refer to any further back payment

It does pay to stand up for whats right, i care for my partner full time and he continues to suffer i should not have to fight for what he is entitled to it really effects him and i dread the time everytime it comes round.

Oddly enough he was excussed attending his last WCA and was awarded 18 months extension and a letter that they didnt consider he needed to appear as the evidence was so detailed.

Any imput is very much appreaciated i do intend to ring the pip line tomorrow but wondered if anyone shares this experience

    If the MR was a review of a decision backdated to May then the result of the MR should I believe also be backdated to May. It sounds as they have treated it as a revision back datedto when the MR was submitted.

    I think on this point you simply have to contact the DWP and ask them to pay the arrears due and if they refuse challenge that decision in turn. Unless you manage to get a result on the phone probably best to confirm in writing.

  • Just give them a ring.
    The helplne agent will probably pass you through to a case manager who will then sort any error out.
