PRA Group, CCA received but statements are incorrect... what next?

Options
Hi all, i'll try to keep this as brief/easy to read as poss, but need some help with the best next course of action

The story so far....

An old debt was purchased by Wescot from Lloyds bank, original debt dates back to early 2009. Wescot then sold on the debt to PRA Group July 2018. I had been making regular payments to Wescot since 2012.

I've never had a repayment agreement with PRA group, wescot were forwarding on repayments made July 2018 onwards.

PRA Group sent me a broken arrangement letter September 2018, the letter set out a brief detail of original debt amount, repayments made, and current balance. But at a quick glance I could see the amounts detailed were way off. The payments received were listed at £300, whereas I've made repayments totalling nearly £1500.

So, I put in a CCA request and today I've had a response. I've been supplied with-

-a cover letter stating requested documents have been supplied, and that the account debt is therefore enforceable
-original loan cca terms and conditions
-statement of payments received, totalling up to £1165 (Pra claim £306 paid to date)
-printouts of screenshots showing account activity (with a halifax logo in the corner of the screen... despite the loan being from Lloyds??)

So...
1- looking through the account activity screenshots, the original debt balance as stated by pra group isn't listed.
2- repayment amounts between statement provided and claimed as received by pra group so far are well off
3- repayments made to wescot since july 2018 haven't been listed despite pra/wescot saying that these would be forwarded

I'm knocking up a response letter, but wondering how much detail i should include or how it should be worded. So far Ive put in that the original balance is incorrect, payments made incorrect and therefore outstanding balance is incorrect referencing back to amounts stated in the broken agreement letter. Should I not include this.... or what else would be my best next course of action??

Thanks for taking the time to read if you got this far!

Do you accept that they've sent a copy of the original agreement? Not just the terms and conditions.

Did it actually have your signature on it?
  • I haven't received the original agreement with signature/date on it. There was a letter sent out by PRA when they received my cca request which set out what i should expect, and it says that if the original isn't available then they should provide a reconstituted copy, which doesn't have to include signature or date ??

Defo chase up the missing payments, make sure they know it’s a complaint.

Recon CCA is acceptable, as long as it’s legible and refers to the actual account it should.
