SORN Vehicle & Parking
Hi all,
First of all, let me wish you all the best in 2019.
My problem is following:
I received a very nice wish card this Christmas from DVLA. It says that I had been seen using my vehicle while it's declared as SORN, DVLA kindly asked me to pay £280 fine. So I replied them and sent my appeal as my vehicle is without working engine and I thought that it must have been either one of the Christmas miracles or some kind of mistake, I supported everything with photo evidence (as they sent me no CCTV evidence, just A4 full of text) + my statement.
I have received their reply today.
Let me quote:
"I have considered the information you have supplied, but as the law requires that any motor vehicle which is used or kept (i.e. parked) on a public road must be taxed." END OF QUOTE
This time they supplied a photo evidence. There is photo of the back of my car (with LP) and details such as Date/Time, GPS Code, Location of offence, Reference, etc.
As far as I know, a public road for DVLA is a road maintainable at public expense, to quote in full:
A SORN declaration is valid as long as the vehicle is not on a public road - a road maintainable at public expense - s.31B(3) & s.62, Vehicles Excise and Registration Act 1994.
My vehicle is parked on private land, there are signs everywhere, also you need a permit to access those premisses. So I'm getting pretty frustrated here as I don't get it.
I've just checked provided CCTV evidence and I found something very interesting. That photo was obviously taken in the car park where my car is parked in. The GPS coordinates are correct, but "Location of offence" doesn't correspond with those coordinates. There is completely different address, even a postcode is wrong. This might be my way out of this, or not?
Is any good soul here with experience with this willing to share advice and opinion?

If it's a private road and the parking is looked after by the council then I don't think there is much you can do about it.0

Yes, totally. The car is parked in SE8 and there is SE15 in the letter. The closest SE15 address is about half mile away from the car. Btw, street name is not correct as well.0 -
If it's a private road and the parking is looked after by the council then I don't think there is much you can do about it.
Luckily, this is not the case. The car park is looked after by private company, there are no council wardens. The whole premisses are maintained by companies, council has nothing to do with it. The closest public road is about 60 meters from my car.0 -

Just wondered if maybe the landowner or someone had reported it to the council/police as abandoned.
If I owned a car park (especially so in London) and had random engineless cars left there I would try to get them removed.0
