Thank you Sal I was just explaining that to my husband-completely immoral in my mind and wouldn't be in her nature to do so. Of course the friend has benefitted but so has my friend and incredibly grateful-shes prepared to pay her way and wouldn't look to obstruct the house sale in any way.
I have looked on gum tree-not managed spare room yet-and yes there seem to be some reasonable options on there so at the very least I can start reassuring her that there is a solution-her current high anxiety levels don't help with her logical thinking and set her into panic mode-so if I can reduce those to a manageable realistic level then I feel like I am helping constructively. I feel a bit ineffective in being able to help otherwise!!

An adviser from where? There are a lot of charlatans out there selling debt solutions to desperate people that aren't necessarily the best solution fir them. If she had been a home owner I could understand why an IVA would be the right choice but since she isn't a home owner I would have thought a DRO or maybe bankruptcy would be better options. As well as the housing situation perhaps steer her towards National Debtline for debt advice.0 -

I don't know why people keep suggesting she overstays her welcome, when there is a pletora of alternatives.
Regardless of whether it's legal to do so or not, it's not moral. I don't believe it's a good idea for someone suffering from stress and anxiety to alienate her friends.
Sometimes you just need to choose the lesser of two evils. If she can't find alternative accommodation then it's a choice of waiting for the tenancy to be legally ended or being homeless. Which would you choose?
The landlord could help by serving proper notice since it could gee the council into action. If you were the landlord would you not help your friend out by issuing a Section 21? I would.0 -
Without knowing the process in full I believe that she had to submit all her debt, income and financial details through an organisation who negotiated the IVA with those that she is in debt to. I know that she consulted CAB and I believe that this adviser came from an organisation that she was directed to for this purpose. As far as I'm aware when her income drops/rises or outgoings increase/decrease she is able to have that financial situation reassessed. Currently she's paying that IVA based on £400 pcm rent outgoings-which as people have indicated should be enough for a room rental. Availability of suitable affordable rooms accessible to work remains an issue-but not insurmountable from the searches I have done and I am unaware of the impact an IVA might have on any potential landlord taking our credit references-naturally wanting to ensure that any individual can pay their way?
