Current landlord provided incorrect information when referencing

Hi All,

Can someone help at all? My current letting agent/landlord provided incorrect information about rent payments when providing references what has resulted in the application being unsuccessful. Further, we have lost the possibility to rent the place and lost £300 even though the landlord has corrected their mistake. Can you please advise if is possible to get the money back? The reference process failed but not due to my mistake.

  • If he has provided incorrect information that has caused a financial loss you can sue for that, but may be hard to prove.



    Exactly what was inaccurate about rent payments?



    A landlord or agent does not have to provide any reference, but if one given must be accurate
  • The current landlord said that everything single rent payment which we made over the past 3 years was late which was not true. Unfortunately, we have found out about it after the potential tenant already received the reference and said no to our application. The property is no longer available and the fee non-refundable.

    The referencing company has confirmed that the current landlord made another phone call today to rectify this but it was too late and the potential landlord wanted the property to be advertised again, therefore we lost the place and £300 worth of fees.

    Well then sue for the £300

    I am confused who is the potential tenant who has said no?
    Were you ever late in your payments or were you squeeky clean ?
    Depending on the answer I personally would sue your current landlord for the £300. I doubt that he/she would defend

  • Apologies, the potential landlord said no after seeing the first references, before they were corrected.

    We're squeaky clean, the current landlord called and apologised, also changed the statement but it was too late.

    And then when they need a landlords reference for the next rental place, he will be ALL too obliging to offer a glowing reference when theyve just sued him for £300.

    I agree its an all round rubbish situation, but they need the landlord to be on side.
  • It is rubbish, to be fair we are now super anxious that we pay some other agency £300 for application and they make the same mistake again only cause 1 person manages 150 apartments...

    I have raised this with them but they came back to me that they made mistake but are not liable for the money we lost cause it's not their problem that the potential landlord didn't care to check/accept updated references.
  • In scotland such fees are illegal: Arguably since 1984!
