BW Legal Letter of Claim - 28/12/2018

Hi there,

I have received a Letter of Claim from BW Legal on the 28/12/2018, saying they have been instructed to commence legal action in the form of issuing a claim against me in the County Court, on behalf of Britannia Parking Group Limited, for a contravention from July 2017. I have until 01/02/2019 before "we are instructed to issue a Claim against you in the County Court without further notice".

I have received previous correspondence from Britannia Parking over the course of the last 18 months, ignoring the offers of early payment for reduced fees and threats of Debt Collectors. I have kept all previous correspondence, and not deemed it necessary to respond to any of them from either Britannia Parking or BW Legal.

I have ready the newbie threads on the main page and other BW Legal Letter of Claim posts, however feel I am in a slightly odd position that I can't quite align to any of the other existing threads, in that I have not responded to any letters or issued a Subject Access Request (SAR) to Britannia Parking, as I never received a Letter Before Claim from BW legal.

The letter from them appears to have all the required information on, it contains;

- Client - Britannia Parking Group Limited t/a Britannia Parking
- Account Number
- Vehicle Registration
- Contravention Description - Failed to make a valid payment
- Contravention Location + Date

I am wanting to send a response in my defence to either Britannia Parking or BW Legal, however wanted to confirm if this was the right court of action at this stage. I fear I may have left my legal response too late and may have left myself with a hefty fine to pay.

Any advice or guidance would be very much appreciated!

    Same as all the other Britannia 2017 cases here right now.

    Most have never responded, same as you. Search the forum for Britannia 2017 and change the 'ADVANCED' search to 'show results as POSTS' and you will see similar threads. Remember Brit do not know who was driving and didn't use the POFA in 2017 (as discussed on all the other threads already).

    The Letter of Claim that you have received is exactly the same as a Letter Before Claim.

    So deal with it as described in the NEWBIES thread - send a SAR.
  • KeithP - Thank you very much for this clarification, I couldn't see anywhere on the newbies thread about a Letter of Claim sometimes being a Letter Before Claim! This is good news as I can issue a SAR as you have suggested above. Thanks for the speedy reply and information!
