Splitting a Council Tax Rebate with flatmates long gone

Just found out we have a rebate due from a dormant account. Low level, amounts, under £100 each.

We've tried contacting an old flatmate for their share but aren't getting a response. How long should we wait?

    He has 7 years in which to claim a debt owed to him. But of course you can drink his money now, and if he claims it in 5 years pay him from your savings/income at that time.

    Who's name is the council tax bill in? Are the the council pay the full rebate to you or are they asking for the old flatmate's details?

    If you receive the lot, then you need to make reasonable attempts to contact the ex flatmate, and keep some proof (eg copy of an email/letter/text). You could try asking the LL if they got a forwardign address or message the last address/number you have for them.

    If you get no response, then hold on to it, but don't spend it (ie keep at least their share in your account and pay your bills etc as if it wasn't there). The flatmate has 7 years to claim this off you, if they ever to find out there was a rebate and can contact you. Then worst that could happen is you pay back their share, but shouldn't be stung for any court costs etc if you have the proof you tried to do everything to pay it to them.

    Given the low amount and apparently low probability of him getting back in touch with you (or figuring out that there's any rebate due), I think safe enough just to split it among you. As long as you realise he's entitled to his share if he ever turns up.

    Or if it's easier on your consciences, give it to charity.
