HELP! Charge on House HELP!

Hope someone can help.



(09.05.2007) RESTRICTION: No disposition of the registered estate is to be registered without a certificate signed by the applicant for registration or his conveyancer that written notice of the disposition was given to Aa Personal Finance Limited at care of Eversheds LLP of Fairfax House, Merrion Street, Leeds, LS2 8HE being the person with the benefit of an interim charging order on the beneficial interest of ............. made by the County Court on April 2007.



We are looking to sell our house and want to get this paid when its done.


We have contacted AA they have no record of this anymore.


We have contacted Eversheds LLP they have passed it to Drysdale Solicitors


We have contacted Drysdale they say its been passed to RBS


We have contacted RBS who have no record of this!


We have hit a wall! :mad::mad::mad:

We need to know who to pay in order to sell the house.


Anyone know what we can do?
Can we have a charge taken off showing evidence that no one knows what it is?

    Your solicitor will need to withhold the amount in question and make efforts to get it paid to the relevant party (this may cost you extra)

    Assuming the amount is known! It won't be specified on the Charges register and if everyone is denying knowledge then it could be for £200 or £200,000!


    I believe you can apply to the Land Regisry to have the Charge removed. I imagine you'll have to show written evidence from each party in the chain you've described.

    Has your solicitor served the written notice as per the restriction?

    That's all it's saying that they have to do - it's only an interim charging order which sounds like it was never made absolute.
  • We knew about the debt (we were young and stupid)
    We are trying to do the leg work to save money at the solicitor stage.
    Currently, the house is up for sale but wanted to make sure everything was sorted before the sale.
    The Mortgage company hold the deeds and they have no charges on the property their end and don't know anything about and said they should have been informed.


    What I don't get is no one knows anything about it!
    We are currently gathering evidence of all we have contacted to pass on to the solicitor.



    Apparently, if we can show proof of who we have contacted and that no one is claiming ownership we can write to Land Registry and have it removed?
