With the responses I have received on this forum to my dilemmas with renting you are better if speaking to anyone else but the people here. These people will bully and crush you to make everything your fault without offering any helpful advice.0

Thanks Smoothape I do feel it's quite unfair as I did the correct procedures from my part but my father is also at fault here and whilst I feel like the victim if in the eyes of the law I'm liable then I guess I need to face what's given.
If anything this is where maybe the law needs to be reviewed as the LL and EA have far too much power over the tenant ( well in this case).. although saying that there are probably alot of decent EAs that would of acted accordingly upon me serving notice.0 -
The OP has been offered sound, useful advice on this thread as you were on yours.
Difference is the OP is open to accepting the advice they are being given as they by law are liable. That isnt a matter of opinion it is a fact.
Hijacking someones thread where they have received helpful information to make an informed decision, just to make disparaging comments about other contributers is very poor etiquette.0 -
I appreciate everyone taking time out of their personal time to respond... It's nice to know people will offer advice even if it's isn't what I want to hear, at least now I know not to invest anymore time into it trying to fight it or spending money as I was going to try and have it set aside.
Happy for the mods to close the thread as I believe I've recieve all the info possible.
Again thanks0 -
Darn. I guess I shall do some more hanging on.0

Theclerson who has failed you is your dad by not moving out when you did and look for somewhere he could afford. Joint tenancy is that, joint. The moment you signed it, you agree that you'd be jointly responsible. You can't be joint when it suits and de-joined when it doesn't.If anything this is where maybe the law needs to be reviewed as the LL and EA have far too much power over the tenant ( well in this case).. although saying that there are probably alot of decent EAs that would of acted accordingly upon me serving notice.0 -
I serviced notice at the end of the FT and left the property, the TA agreement I signed stated one person serving notice is all that is required which I did.
Yes my father has let me down by not moving out but from my part I did everything necessary which the contract stated so it's not a case of being joint when it suits and de joint when it does, if that was the case and I was trying the buck the agreement I wouldn't of bothered asking for advice on here!0 -
Sorry to hijack this thread. But I have a question along a similar vein but from my side as a landlord. Cant seem to be able to start a new thread. Anyone help?0

Yep, the people here are terrible!
They offer free and accurate advice and all that, but they never tell you what you really want to hear!.....0 -

The notice should have ended the tenancy. Whether the tenant(s) who DO move out can be chased for double rent because of the failure of one or more other tenants to move out is an interesting question I haven't come across before, though I'd be surprised if a judge enforced that!
In joint tenancies there is only 1 tenant; just happens to be 2+ people.
The actions of any individual are the same as though they were committed by all of them.
By failing to leave, the 'tenant' (legal meaning) is liable.0
