Hi
I am new to this and just needed to understand what i can do. I am self employed and in December i won a small courts claim against a company for breach of contract. They have still not made payment although the payment date was 28th December. What can I do to enforce payment and how can i make sure their credit rating has been affected?
Thanks in advance for your help

Hi,
Your enforcement options are :
Send County court bailiffs
Obtain an Attachment to earnings order
Upgrade to HCEO (High Court Enforcement Officer)
Petition to make them Bankrupt
All have further fee’s attached to them.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. The CCJ will impact the companies credit rating negatively.0

Do I pay the fees for this or does it get added to the amount that they owe?0 -

Would this happen automatically?0 -
By not paying the order within the time allocated by the court they now have a CCJ on their record. This could impact their ability to get credit including business finance.0

it is a business I sued. Is their credit rating automatically adjusted or do I need to petition something?0

As has been mentioned many times above, the CCJ will be recorded on the businesses credit report / history. You do not need to take any action to make this happen.
How lenders view the CCJ, and the businesses credit-worthiness is not your business. Lenders will make their own minds up, but they will more than likely view the CCJ negatively.
Why are you so concerned about the businesses Credit report? It will not help you get your money faster. As mentioned on the first reply..sourcrates wrote: »Your enforcement options are :

It won't make me get the money back quicker, but it was never just about the money. This person acted unethically and tried to damage my reputation. I had to make a complaint to his industry governing body and they have him under restrictions. I just want to make sure he suffers all the consequences of his actions. It is not sour grapes, he has affected my income and my health for the past year.0

The cost of enforcement action gets added on to their bill. In saying that there is no guarantee you will get anything. If the company has no assets then there won't be anything for a baliff to seize.0

Sounds exactly like sour grapes to me.
If you want the money then you will have to spend some more to try and get it back. Otherwise just leave it and see if they come to you to clear the CCJ.0
