    Fair enough, but I had the impression that OP was more confused about what the rules were, rather than looking to get the vendor to break them?

    Yes I wasn't trying to get the vendor to break the contract with their initial estate agent, just trying to determine what the best next step was for us as we felt in an awkward position with the agent changing so soon after us making an offer and when we are interested in increasing. The property had been up for around 11 months with the previous agent so I understand why the vendor has decided to try someone else.

    If your offer was under the asking figure is it not more likely that the sellers have been told of it and are not interested at the price you offered? Especially if you haven't heard back from the letter you sent them directly
