Unless you are trying to use a non-compliant NtK as protection for the keeper, it doesn't matter, but in any case, as you've identified the driver, it's rather moot.Unfortunately, when an appeal was submitted to the PPC, an admission of who was driving the vehicle was made - how does this change my defence, and what precautions do I need to make in court?
Fully admitting to being the driver avoids you potentially looking shifty in front of the Judge.
As a point of law it has no applicability to your defence. You could us it as a 'for example', but it looks a bit like an attempt to conflate the issues.Also, what does everyone think about using the road traffic act as a defence?Please note, we are not a legal advice forum. Dear All,
I have a court hearing date set for one of the PCNs. The later of the PCNs has been withdrawn by the Claimant - perhaps a sign of weakness, or is because this would constitute double jeopardy in court?
I will be issuing the paperwork to the courts as well as to the Claimant as I have read the guidance on this forum.
I have a lot of questions about the process in court. Could anyone tell me what will happen on the date?0 -
