Keeper liability & incorrect address

Hi all,

I've received a Parking Eye PCN today as RK for vehicle, advising the below. Can confirm this is the first correspondence I've received regarding it; alleged offence was 07/11/2018.

"ParkingEye previous wrote to you at the address that the above vehicle was registered to at the time of the parking event. This address was provided by the DVLA. However, it has come to our attention that you no longer live at this address but reside at the above adress. This new address has been supplied to ParkingEye by a Credit Reference Agency."

The V5 document will be in an old address, however the vehicle's insurance was renewed in August and should have the correct address on. Driving licence has also been updated long before the parking event occurred.

Do I have grounds to dismiss this as ParkingEye are out of timescales, as it isn't my fault they have an incorrect address as all details were correct (except the V5 - does this need updating when RK moves house?). Or should I proceed as business as usual with the template response?

Any help would be ace

  • when obtaining details from the DVLA the parking Co are given the name and address that is shown on the V5

    they do not interrogate the insurance database or indeed driving licences

    by failing to update your V5 , you are at risk of not only getting a £1000 fine from the DVLA but also finding that the POLICE and COURTS , who have the ability to cross ref would not think twice in giving you points/ban if you failed to reply to a genuine speeding charge

    More you know, had no idea of this! Side point, therefore - can V5 be updated online or is an over-the-phone job for DVLA?

    Take it I shouldn't draw PPCs attention to this oversight then, and just plough on with template letter and POPLA code?

  • you should contact the parking co,s data protection officer and update them of your present address

    as they have written to one address with no reply then to you at the present address , failure to reply will simply result in them starting a court claim at either address , knowing you will not reply , and they will get a default resulting in credit clamping

    Yes and it would have been quicker for you to Google that than ask us!

    Just plough on but confirm your new address as well, by adding a line to the appeal. You are allowed to appeal at this stage so do so and if you have a receipt for spending at shops onsite you obviously attach that too, as the NEWBIES thread tells you (without saying 'MY receipt!).

    What are the circumstances and what sort of car park? Many retailers (e.g. Morrisons) will cancel these when you complain to their Head Office.

    So where and what happened?

    Driver overstayed in ASDA free customer car park limited to 3 hours maximum stay, by 48 minutes. Other than that, fairly straightforward and no other notable circumstances to it. Driver won't have a receipt from ASDA, so can't go down the landowner cancellation route as far as I'm aware.

    I'll bob over template appeal to ParkingEye, amending it for correct address that vehicle is currently at, and wait for POPLA code.

    In my opinion, you don't have to show your personal data in a private car park (it's different on street). But we don't condone not paying a reasonable fee to park and have never posted or suggested anything like that.

    You can keep your car on your own or someone's driveway (or in a car park to which you are invited) with the numberplates missing - e.g. if you are replacing them - and you can cover your car too as many people do in the Winter.  All perfectly legal.
