URGENT! Outstanding disputes now neighbour is moving

Hi, Long story short...
Neighbour moved in above me (masonette) 4yrs ago. Caused 7 leaks, 2 of which were floods. Have seen no proof that he got a professional in to repair last one. Caused long term hidden toxic mould and decreasing health. It was repaired few months ago, but he is not admitting negligence with ins. claim against him - increasing my premium and had to pay the excess. Was told 'tough' DURING one of the floods.

He is a horrible person, among other things, he dug up part of my garden when doing his, and his grown up son vandalised my bathroom water outlet pipe on exterior wall.

Has just put his flat up for sale. Wondering if this gives me some leverage. Any ideas on how to use this to get what is due to me financially? I have been driven insane and had insane thought. Would it be crazy to put poster on my window saying '7 leaks, 2 floods and outstanding toxic mould'. It would say only this, so just a statement, not referring to him, but potential buyers would surely get the idea that they are considering a flat with potential issues. Could speak to him first, show him quote for the outside pipe and would like payment in advance (as he would say go ahead and then not pay). Also wonder if it would encourage him to do the honest thing about the claim. If he says no, put the poster up and see if he sees the light, or am I being naive and breaking the law in any way? Or is this only going to make me look insane to potential new neighbour... Need to act fast! Thanks.

    Just be glad he is going. Why would you want to sabotage his sale, surely its better that he sells quickly and goes.
  • Yes, I have thought of this, it is just so wrong that he would get away with it ALL and no consequences.

    Well you want him out so the last thing you want is to mess up any sale. He has to declare your previous grievances and I would bet he doesn't. So...

    I would say course of action if you wanted to be a little cheeky would be to let him move and get new neighbours, and then get them to go after him for not declaring (if that is indeed the case), as they would have grounds.

    That’s complicated; if he declares himself as the problem there’s much less recourse.

    You can either

    1) make sure any potential buyer knows of every problem, real or imagined, with the upstairs property, thereby scuppering any sale. This results in
    * huge sense of satisfaction for you in making his sale, and his life, fificult
    * escallation of inter-neighbour warfare - who knows how he'll retaliate
    * prolonging your living beneath him indefinately

    or

    2) facilitate his sale by going out to meet all viewers, offering them tea and cake, charming them with your neisghbourliness and answering all quetions positively. this results in
    * him moving away asap
    * you swallowing some bile and the financial losses which you'll never get back either way, and
    * getting off on the right foot with your next neighbour

  • Really would you do that to scupper your chance of a happier life? I wouldn't even do that to mr ex husband and he was a nightmare :)

    Your judgement certainly seems clouded to me.

    Yes, it would be crazy, and it would probably result in something even worse happening if it proved effective. However, it's likely the person above would simply dismiss any enquiries with something like, "She's just a daft woman, but totally harmless."

    Get a grip. You want this person gone, and as your chance of any financial redress is probably zero, be happy that they might not be there too much longer.

    How much has this cost you? Unless you can prove negligence getting rid of him as soon as possible would be my choice. Water leaks can be very cheap and simple to repair, if you are concerned about future leaks you could tell the new owners about the past leaks and ask them to check the repairs are adequate.
  • Stay calm and quiet and just wait for him to go. Fingers crossed the new neighbours are nice.

    Sometimes water leaks can be very difficult to track down and get repaired properly. My parents had umpteen problems with leaking pipes which took a long time to be sorted out, then it happened all over again and no way were they negligent. It was all due to poor building techniques in the 1980's Sometimes these things just happen and that is why we have home insurance.

    Have you ever considered your neighbour is moving away from the flat from hell with terrible plumbing and a neighbour downstairs who constantly complains and blames him for things not within his control?
