Hi everyone

Quick Question on ANPR Notice of keeper.

My dad received his Notice of Keeper fine on the 8th January 2019 for an apparent ‘offence’ on the 20th November 2018.

From my research on this I read that with an ANPR system we should receive a notice of keeper within 14 days.

Should we ignore this fine completely or send a strongly worded letter to them?

    It's not a fine.

    The advice to ignore has not been given here since the law changed in 2012.

    Follow the advice in post 1 of the sticky thread for NEWIES by sending the appeal template in blue from the keeper you will find there.

    You can carefully add if you wish a one liner that the NTK is too late to transfer liability to the keeper so they should cancel.

    Do not reveal the driver's identity at any point.

    Read the rest of the thread on what to do if/when it is rejected.

    neither, POFA2012 is not mandatory, but if they fail it then the keeper is not liable


    it is not a "fine", it is an INVOICE


    read and follow the advice in the NEWBIES FAQ sticky thread, third thread down from the top of this forum, use the blue text appeal and he appeals it as KEEPER


    which parking company is it ?

    in that case expect EXCEL to refuse the appeal, even though its out of time for keeper liability


    failure to adhere to POFA2012 (your research) is what protects your dad if it gets to a court claim, especially if he was NOT the driver


    they will assume that the keeper and driver are the same person and they will proceed on that basis, for up to 6 years

    depends on what I said


    if the claimant can prove that the keeper is liable for the actions of the driver, (or WAS the driver) by whatever means , they would win

    if on the other hand , the keeper was not the driver and the judge believed the defendant , the claimant would lose

    its a game of who blinks first

    but if you are looking for cast iron guarantees, then you are wasting your time, strange things can happen in court

    its a good protection, but not foolproof, and there are many fools driving vehicles and flouting rules , Beckham was a fool speeding , his lawyer got him off on a technicality (late delivery of papers)

    You asked that even though the NEWBIES thread about defending court claims on this forum, tells you that we win 99% of the time?!

    OF COURSE you are as likely to win as the next 99 out of 100 here with a claim!
