When to give notice to current landlord

Hi all,

I have a quick question and I've looked everywhere and can't really find any answer online.

I am currently renting a flat with a standard AST and a 6 month break clause contract. I've passed the expiry date for the break clause so I can now give it when I want providing a month's notice.

My question is, having found a new place to rent, when should I give notice to my current landlord? The new landlord accepted my offer and we will process to referencing very shortly.

I wanted to give notice to my current landlord when the referencing was successful, however the current estate agent doesn't want to provide a reference until I've given notice.

I'm a bit scared that if I give notice and don't pass referencing I'll be out of a place to live in case the referencing fails.

    I think you've kind of answered your own question. Give a month's notice.

    1) exact wording of the Break Clause eg 'a month'? 'a calender month?' ' a month ending on a rent payment date'? What?


    2) unwise to give notice till you have a new contract signed. That may meanan overlap


    3) your agent sounds a tw*t. Yes that's catch 22. If the agent won't give a reference, try speaking to your current landlord


    4) or explain to the new LL and see what solution he might accept

    The exact wording of the break clause is:

    Twelve Calendar Months from and including 26th May 2018 to and including 25th May 2019, with a Six Month Break Clause. It is hereby agreed that any time after five months of the initial fixed term of this renewed tenancy the Tenant may invoke this break clause by providing a minimum of one calendar months written notice to the Landlord such notice to expire on or after 25th November 2018. At the end of such notice the tenancy shall end and all obligations and responsibilities shall cease; subject nevertheless to any claim by either party against the other in respect of any breach of any of the terms and conditions of the agreement.

    I guess I'll play it safe and wait until the new contract is signed as you've suggested. I'll try to deal with the letting agent.
