Incorrect Default hindering credit

hi folks,
Other half was having problems getting a cc so we got the credit reports.
We had 2 mobiles with 02 and closed the accounts but note on Experian they have one account satisfied and the other default for £12 and on Equifax have both accounts down as default.
They are saying when we closed accounts we switched to a PAYG and the £12 that was outstanding was the charge for doing this, but we didnt we closed and went to another supplier.
We never received "anything" regarding this not one reminder let alone a default notice and now having major problems with these defaults and getting no where with o2.
Any help much appreciated.

For a default to be valid, you must be served with a Default Notice, whicj it appears you haven't. You can either write to O2 and include the following in your letter;
1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.77 (1) Consumer Credit Act 1974. Your obligation also extends to providing a statement of account. I enclose a £1 cheque/postal order in payment of the statutory fee.
2. You must supply me with a signed true and certified copy of the original default notice
3. Any deed of assignment if the debt was sold
Or, you can write to the CRA's and contest the information, giving them your reasons, they are obliged to conact O2 on your behalf.0 -
PM me ALW, I work for 02 and have had a simliar issue. they have me down as owing £93 to them when I dont, and I have had 4 more contracts with them since and iI am an 02 employee! So if I did owe them,which I don't, they have had ample opportunity to recover any monies owed! Send me some details and I'l see what I can find out.

Long term CC debt £0
Total low rate loan debt £3000

mparter is absolutely correct. It is possible to get a default notice removed, especially on the basis that one was never issued. I know, because I have recently done it. Here is a link that explains how to do it:

I too managed to have a default removed from my credit files after one was issued during the course of reclaiming bank charges from the Halifax. I was defaulted for £7, while they paid me £3.8K! The Collections Team and Customer Services Team (who agreed to settle my charges claim) weren't in communication which led to the default being served.
In fairness to my least favourite bank, 1 letter to the Chief Exec's office and it was sorted within days.Almost debt-free, but certainly even with the Banks!0
