EuroCarpark, Gladstone Letter before Claim

Hi all,

I know there are numerous threads about this however I havent been able to nail down what action should I take in my case. I been sent a solicitors (gladstone solicitors) letter regarding parking for a private car park through euro parking services limited. I was the driver at the time but not the keeper. The keeper resides between the UK and Turkey. In this case I will need to respond on the keepers behalf so I am not sure what to reply to Gladstone Solicitors. Any advice on what action I should take at this point or if there are any templates would be much appreciated.

Edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people.
The Keeper has protections in law that the driver does not.
If the scammers do not know the identity of The Driver then they can only pursue The Keeper at the time of the alleged event. Who the new Keeper might be in the future is irrelevant.

If I became the new keeper, I wouldn't want to be harassed and threatened by a bunch of unregulated scammers for something allegedly done by someone else before I got the car.

Parking scammers read these fora and have been know to use information from here at appeal stage and in court.

If the person who was The Keeper at the time of the alleged event now has a permanent address for service (an address where they can be contacted by post) in another country then they should use this for all replies. This should be done irrespective of whether The Keeper will be VISITING the UK in the future.
If this is the case, then The Keeper at the time of the alleged event should send a rectification notice to the PPC's DPO telling them to correct the keeper's address details and destroy previous records.

Please note that nobody is telling you to say anything that is not true.

However, if it is, then it would help to provide now or as soon as conveniently as possible, proof of residence at the other address to both the PPC and the solicitors.

In any case, follow the guide to court you will find in pot 2 of the NEWBIES written by a poster called bargepole. It has a step by step guide from LBC to the courtroom, and should be flowed precisely.

One last thing, please use the Edit then Go Advanced edit facility to change your title to the correct name of the PPC. There is one with a similar name to the one in the title, which isn't the one you are dealing with.
You can't do this on a 'phone by the way, you need a grown up tablet, or pooter.

So at the time of the contravention I lived at the same address of the keeper of the car however I was driving it. When Eurocar parks sent me the first letter by post DVLA had completed the transfer and I became the Keeper. At the moment the previous keeper and myself live at the same address still.

WiIll there be a court case involved at this point? and will the old keeper have to contest the fine in court? The problem is that the old keeper isnt always in the UK and I am dealing with this as the driver at the time and current keeper of the same car.

The person named as Keeper at the time WILL be the named defendant, unless you tell them the name of the driver

Instead, why not give them an "address for service" for the keeper of Turkey? They will be unable to file a claim to that addres,and using the old address will be a problem for them.

If the keeper at th time is named in a court claim form you cannot handle this for them, so you want to get this shifted to the address in turkey

Is there any reason why you have not taken my advice to edit your post and remove information about the identity of the driver, and why you have chosen to repeat that information in your next post?

If the scammers know who was driving they do not need to deal with The Keeper, but can instead take The Driver to court.

Even if The Keeper doesn't have an overseas address for service (which would kill this problem stone dead if they did), they have protections in law that The Driver does not.

In addition, is there a particular reason why you have not corrected the name of the PPC in your initial thread title, and continued to use the name of a different PPC to the one you say sent the NTK?

This causes confusion as the advice for one company is often different to the advice when dealing with another.

Hi mate, sorry im knew to this forum so I wasnt aware about the posting rules. I have edited the first post please let me know if there is anything outstanding.

So the Keeper at the time does have an address in Turkey which I can provide however her bank statements are still registered at my current address so she still does get some mail here in the UK and she visits frequently. Will giving her address in Turkey to Gladstone solve this issue?

The DVLA will only have provided the keeper's name at the date of the event. So if they gave YOUR name to the PPC, that must be because you were the rk at that date.
