If water is escaping from a drain, or any pipe for that matter, it can wash out the foundations of the building, which affects both storeys.0

Op the lease will state you have the right to enter the neighbours property (externally) for maintenance issues. To say you can't fix it is a cop out. Why would he even care, you already got it inspected so why wasn't it a problem then?
Just get it fixed, present him with half the bill and then small claims if he refuses.
But as pointed out you still need to explain how your 1st floor property is getting worse and worse.0 -
Is the neighbour the freeholder of both properties?0
