Ps if the max cost to us would £200 altogether and definitely no more I'd take the chance and take it to court for the sake of an extra £45.
I can see why people pay these things though as it's very intimidating and worrying how a company can just keep adding unregulated fees on what is already a ridiculous amount for parking a vehicle for only a few hours.

We know, that is why government is involved now which hopefully will be become law shortly

Fail to read those signs and dump the car is now at your peril.
I agree in principle. However many signs are unreadable ... in my local Aldi the detailed T&Cs on the PE signs may as well be hieroglyphics as far as I'm concerned - even getting as close as I can to them (they're sited about 10' up on poles) I still can't read them.
  • They only worry I have in contacting them now is giving them more ammo for if they decided to take it to court but I guess I've nothing to loose in requesting they accept £60 but if they don't judge and just carry on rolling down the road regardless, as you have all said, then I might as well roll down the road with them and ignore their demands now until court proceedings if any take place.
Does anyone know if they will add anymore fees before court stage now or is this the final amount?

They'll try and add whatever they can, but the only additions are court filing and hearing fees, plus limited solicitor costs (£50), so maybe another £100 on top. However, as said before, they're only entitled to the maximum PCN charge (was this £60 or £95 or £100?), plus court/solicitor fees.

Their claim of £155 suggests a PCN of £95 plus £60 "debt recovery" fees ... the latter is borrocks and not allowed.

So, simple, you do not talk to them. However, you need to prove something to yourself now, then come back here when you realise what we are saying is fact

The standard PE signs are appalling with a massive wall of point 4 font text at the bottom of the signs. I've tried to read them on many occasions, but failed to keep focused (sight and mentally) long enough to get to the end.

But as unreasonable as they might be, it's only likely that a Judge would make that decision. Park and contravene them, you've got a PCN and quite possibly a court case to occupy a lot of your time for the next 6-12 months.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Hmmm lot of food for thought.

I'd rather not have 6-12 months of my time wasted as it'd be better spent elsewhere especially as the amount in question is about half a weeks wage when I return from mat leave so to loose 2.5 days money vs 6-12 months fighting my corner. I'm sure most would just pay it and draw a line under it.

Just gutting they can do this and get away with it.
Sadly the edit button doesn't seem to appear on my phone I'll keep looking but thanks for the tip!

They're just bullys and the PCN amount was £100 they've added £55 on top since they sent into their internal collections team.

It's just a shame I don't have a crystal ball to see if they'll actually take this to court or not. If they have no intention of doing then I'd just ignore any further correspondence from them.

Will research into all the info you've all helpfully provided to help me and will discuss with the other half and see what he thinks too.

They must've made a fortune that night as there were hundreds of people parked there too due to the signage being so poor nobody had a clue and that's what they bank on.

Thanks I appreciate your response. Do you think I could say I sent a cheque in for £60 following the rejected appeal and I'm shocked to find this has not been cashed and you have send me a further letter for £155?
No, stop spinning around and panicking.
I realise we've been naive in thinking they'd send a letter in response to our appeal and now faces with £155
No you are not. No-one pays MB unless a court Judge says so, very rarely do we see cases lost at court claim stage if that happens. We assist people all the time to avoid these scams.

We know. You cannot possibly use the forum properly on a phone, or do justice to your research, or defend the case properly.

No-one tells you to fold & pay.

That would be FUNDING & sponsoring the scam against the next unsuspecting victims, and we aren't happy when the odd weak poster says they will pay. No! We will help you beat this and defend it if a court claim arrives - no risk, no CCJ.

Have you read the NEWBIES thread yet?

If you appealed & got no reply, why not email Steve Clark at the BPA like in other threads (search Steve Clark as keywords, but not on a phone).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thank you I appreciate your response.

Ha we are panicking a bit naturally.

We did receive a response to our appeal but it was by email and not by letter as the other correspondence has been from them so we missed it.

Only thought to check our email after the second letter arrived this week requesting £155. I'm just so annoyed at the whole thing as I don't have the time currently to deal with these crooks so I understand why people do just stump up.

As we missed the appeal response which was sent by them on 3/12/2018 and we only saw it this week, we've missed our chance to appeal with popla or pay the original £60 fine so now stuck with an inflated invoice of £155.

Do we just ignore them now and see what happens and deal which each bridge as we come to it?
