PCN advice for fluttering ticket

Looking for some belated advice on behalf of my other half who picket up a PCN when visiting a better leisure centre. Nothing like a PCN to get the heart rate going...!

She bought a ticket but during the course of getting a toddler and baby alongside pushchair etc out of the car it look s like the ticket slipped from the dashboard and landed on the drivers seat face up.

Anyhow she only realised that this had occurred when she got back to the car and saw purchased ticket on the seat and a PCN on the windscreen.

She completed a template letter explaining what hadn’t happened alongside a photograph of the ticket to Gemini parking solutions but has been told to mug off, pay up or appeal and pay £100 should she lose.

Appreciate that the advice states that she shouldn’t have appealed right away but she panicked and naively thought that they accept that it was a legitimate missunderstanding.

I’m not really sure what she can do feels a little discriminatory not to take into account her circumstances. Should we just pay up? I’ve written to better but past experience (gym memberships) tells me that they will at best not reply at worst reply in about 6 months time saying no can do.

    she should not have told them who was driving either, and not appealed quickly (as you correctly say) - it certainly was a legitimate misunderstanding, welcome to the world of sc@mmers masquerading as parking companies

    so this "fluttering ticket" was not fit for purpose as it had no sticky part to attach to the windscreen

    she should now appeal to POPLA after studying other "fluttering ticket" popla appeals on this forum over the last 2 years

    the landowner cancellation is still the best option though (it always is)
