It isnt relevant to your court claim at all, really. You can state it has restricted yoru ability to provide evidence as they failed in their legal obligation to... but dont expect a free pass.

You should complain to the ICO and the IPC pointing out their member is failing to fulfil its basic legal obligation relating to personal data.
