Neighbours Access Rights

A family moved into a house next to my daughter's house.
The houses are separated by a drive which is partially fenced.
Where the fence exists my daughter's drive is approx 3m wide whereas the neighbours side is approx 2m. The unfenced area is approx 4m deep (from the pavement to the actual fence)
The previous owner never parked in this narrow space. My daughter can and does enter/exit her car on one side with having to step onto the neighbours side of the drive.
The is no way the neighbour can enter his car without walking on my daughters drive (except through the tailgate). When my daughters car is parked then they cant open front or rear doors.
The new neighbours are reacted angrily in this situation.
As far as we know, the boundary is as described and there are no access rights for the neighbour to use my daughter's property.
So the question is whether the neighbours have any right to access their car and whether they can demand my daughter moves hers to facilitate this? Are they in fact trespassing?
Any suggestions ?

    Have you actually checked what the titles say?
  • How much of an inconvenience to your daughter would it be to park her car further over?

    You need to establish exactly who owns what and who has what rights.


    Refer to your Title document.



    * What exactly does it show on the Plan?
    * What exactly does itsay in the register?
    * does it refer to any other document?If yes, look at that and then quote exactly what that says.
