Hi all
Recently I have taken in a young lad I know as a lodger he has fallen on hard times and I was close to his mother and his family he has no where else to go.
Since I am not a registered landlord he receives no housing benifit at this stage that's not the problem.
I spoke to the local council and they have said if he is staying their they need a tenancy agreement and of course double occupancy council tax I don't have and neither does he the money to pay for becoming a landlord at my own property. since this is the case and no one financially can help he has been trying to stay with freinds moving around but I have said he can use my postal address for his benifits so he's still receiving some money how will him using this as a postal address effect my council tax ?

He is not, and never will be, a tenant. He is a lodger. He needs a Lodger Agreement or contract for an 'Excluded Occupier'.they need a tenancy agreement0 -
it is without question his main residence and therefore you cannot claim the single person discount , you will need to pay full council tax
whether you want to get his status formally recorded on paper so he can then make a benefits claim and presumable pay rent to you to cover that extra charge is a matter for you to decide.
It won't impact the fact you must pay full CT whilst he lives there. Your statement that he is sofa surfing at friends properties also won't stand up if you continue to claim single person discount0 -
G_M it's Scotland and I don't expect to not pay council tax it was mainly to give him an address to claim his benifits but since he isn't to receive housing benifit or a council tax reduction he's now becoming a statistic in the homeless numbers now as he can't afford to stay and I can't afford to keep him

He's a common law tenant. He can have a written agreement, better for you too if the contract is in writing, but you don't have to be registered with the council since you're a resident landlord. You will lose your single person discount.

My local council support a scheme where people take in lodgers in return for a little help around the house; not sure what it would affect or if your council run a similar scheme.0 -
Can't you make it a formal lodger's agreement so that he can get housing support and pay you for his board and lodging, enabling you to pay the additional council tax?0
