ParkingEye Parking Charge Notice

Hi All,

I have received a parking charge notice from Parking Eye. The driver went for a Christmas meal in a Marriott hotel restaurant. amount is £100 reduced to £60 if paid within 14 days.

They have a pic of my car entering and leaving the car park and they state my car was there for 3 hours and 21 mins.

It was pitch black and pouring with rain on the night and the car park was so badly light that it was dangerous needless to say the driver didn't see any signs re parking. The driver was greeted by the maître d of the restaurant who didn't mention anything about the parking. The restaurant was really busy as expected during the Christmas period and some of the party members friends had an issue with their dessert so had to wait for the Manager to come and speak with them which took time as it was busy.

I have seen the blue template in the pinned post which i plan to use but my question to you is, do i add any of the info above and also the restaurant booking confirmation to add weight to the argument or do i just send the template as it is?

I am not even sure if the driver is being done for not getting a ticket at all or for overstaying?!

I also plan to write to the hotel and complain to them.

I have recently been to another local hotel where there was no more that 5 reminders to pay for parking - it would have been nice if the Marriott had done the same.

    You are advised to use the blue text appeal as is, no additions, deletions or modifications and that way you don't inadvertently blow your toes off by admitting who was driving. Anything else (such as mitigating circumstances) comes later if/when it gets to a small claim.


    Do complain to the management laying it on thickly but politely that you cannot afford to eat there again if the "Service Charge" is £100 or mroe.

    Complain to your MP as it is the will of Parliament that these scammers be put out of business.

    Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    Marriott staff should have warned you there was a parking cowboy

    Ask him to arrange cancellation if he wishes to retain you and your family's future business.

    In the UK Marriott are not doing very well hence offering discounts on TV .........Play the game

    Thank you every for your advice. I have submitted the appeal online using the template and i have complained to Marriott hotel in question and also the Marriott President.

    It was the driver that didn't see the signs.

    i will write the letter to the marriott in the same vein i.e. from the driver.
  • Just a quick update to say that I received 2 separate email replies yesterday, one from the General Manager of the Marriott hotel in question and one from the General Manager of the restaurant within the hotel and both have said they have emailed ParkingEye to cancel the parking charge!

    I am delighted! - thanks again for all your advice.
