County court claim - please help
Comments
-
Just to add, the particulars of claims are as such:
The driver of the vehicle reg ***** incurred the parking charges on ***** for breaching the terms of parking on the land at (address)
The defendant was driving the vehicle and/or is the keeper of the vehicle
And the claimant claims:
£160 for parking charges/ damages and indemnity costs if applicable, together with interest of £9.83 pursuant to s69 of the county Courts Act 1984 at 8%pa, continuing to Judgment at £0.04 per day.
Does what I wrote in my defence with regards to the particulars of claims make sense with this? Because I also stated that they gave no calculation for the extra charges but to some extent, they seem to have given some sort of calculation in their particulars?0 -
What indemnity costs can they recover/did they pay to any third party? Answer - none.£160 for parking charges/ damages and indemnity costs if applicable,
Yes, that's a vague template POC, same as all the others.Does what I wrote in my defence with regards to the particulars of claims make sense with this? Because I also stated that they gave no calculation for the extra charges
No they haven't. £60 'indemnity costs if applicable' - what does that mean? It means nothing at all.they seem to have given some sort of calculation in their particulars?
Your case is exactly the same as all other Gladstones cases.
Please read some, it'll help you see you are on the right track & how people keep winning here.
You could search this board for the words: UKCPM another one bites the dust and find all the 2018 wins. And you will see the POC by Gladstones are always like that, and what happens next.
I really stress the importance of you reading other UKCPM claim threads. Please don't post later, saying you 'got a letter from Gs saying they want the case heard on the papers' and what should you do... please let's not see that again!
You will know what I mean when you come off this thread and read UKCPM claims that have gone before, and you will then be expecting and ready for every stage along the way and know what to do.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sorry to update the thread so late, I've had the busiest week at work. Just wanted to say thank you for all your help and I submitted my defence via email with a few minor changes after reading a few more threads like you recommended.
I feel a little more at ease now, just waiting for the next steps! Will update accordingly.
Thanks again everyone0
