Change of rental payment date - week later than normal

hi, i have a question which I hope someone can help with! I have a great tenant who has been in the rental apartment for a year, never with a late payment in the past. I believe she's changed jobs and she has just requested if she can change her rental payment date now that the 12 months AST is over and has gone into a rolling 6 month contract. The original date of payment each month in advance is on the 10th, she's asked if she can start paying on the 16th instead.

Does this have any complications if any arrears do happen in the future?

    The only implication I can see will be a change in dates for serving notice if you want to bring the tenancy to an end, so nothing huge.

    Just make sure the change is documented, and ideally signed by both parties. Also make sure that you allow for a transitional payment (i.e. either the last payment made on the current payment date or the first payment made on the new date will be for more than a months worth of rent).

    As Da-Rule says:

    * document it clearly
    * take an extra week's rent to cover the 10th to the 16th in the month of the change

    But I disagree about the notice: the date rent is due/paid does not alter the tenancy dates, so does not alter the notice required.

    If the tenancy is in a fixed term with an end date of xx/xx/xxxx, that does not change

    If the tenancy is periodic, with periodic dates of 10th to 9th of each month, that too is unchanged just because rent is paid on the 16th.

    Of course, when such a periodic tenancy does end, the final rent payment will be for 3 weeks since it will cover the period 16th of the month to the 9th of the month when the tenancy ends (hence the importance of clear documentation!).
  • Thanks for the replies! I have managed to arrange a bridge payment as suggested to then amend the date of new payments accordingly. Tenant was very reasonable and more than happy to agree to the transitional payment as suggested! :T

    And if so, why is rent being paid monthly, not 6-monthly..........?
  • It's my understanding that a 6 months rolling contract are still paid monthly? Apologies if I haven't worded it correctly.
