Just eat is responsible for refunds.

I saw a few threads about whether Just Eat are legally responsible for food that was never delivered or gone bad. Yes they are.

I ordered £33 from Pizza Bite Grill a few days ago, and it never showed up. These guys are the dodgiest restaurant I have dealt with.

Pizza Bite Express London
Address: 15 Ridley Rd, London E8 2NP

The owner literally lied and told me on the phone that it had been delivered. I told him I have a CCTV camera which proves no one approached the door within 8 hours of the alleged delivery time.

I complained to Just Eat, who basically said they were a middle man and not responsible, which is complete BS.

Just Eat have no customer security. If a restaurant lies about a delivery being made, but tells Just Eat they did deliver, that is the only evidence needed for them.

More and more takeaways are figuring this out, and selectively scamming people. Say, 10% of orders.

The payment is made to Just Eat. Just Eat advertise the restaurants and are responsible for the vetting process and customer safety. Anyway, after a lengthy back and forth, they DID refund me £33, which proves they legally have to do this, but keep it hush hush.

Scummy company

Companies do stuff they're not legally obliged to all the time.

Never had an issue in four years. Ordered food always turns up, I'm not missing one in ten orders. Dodgy London?

    No, it really doesn't.

You pay Just Eat to place the order for you, nothing more. Once they've done that their contract with you is compete. Much the same as booking a hotel or flight through an agent.

They paid you off because it costs them less than debating with you or defending a court claim.

I really hope the OP doesn't have a job where his legal opinion is relied on.
