Appealing PCN as a hirer.

Hi guys,
Attempting to assist a family member with appealing a PCN. Ive read through the stickys and think I have a fair grasp of where we stand. Car is a lease car through Leaseplan and was parked for a short while in a residential area in town while parking permit was retrieved from a friends house. In this time PCN was slapped on windscreen etc etc.

My question is, the supposed offence took place on 16/11/2018, and apparently an NTK was sent, but went to previous address as we had moved house soon after. Only after them chasing and going through Leaseplan did a photocopy of the NTK come through to the new house on 02/01/2019. It did not come directly from UKPC.

Can we use this within an appeal? Should I have a notice to hirer and not a notice to keeper just photocopied and passed on? Obviously they cant assume who was driving as per POFA, but im wondering if I've missed anything. Should i just use a basic template for an appeal, if so which one would work best?

    You could win on the fact that the PPC failed to issue the correct paperwork in order to hold the hirer liable.

    [STRIKE]If it's a BPA operator, POPLA provides the route and with a decent track record.

    If it's an IPC operator, then it will probably need to wait for a Judge, should the PPC decide to sue.

    There is an appeal written specifically for hire/lease vehicles in post 1of the NEWBIES, separate to the standard blue appeal template. It's written by Edna Basher so that is the one to look for.

    Did the scammers get the (day to day) keeper's address from the lease company, or does the day to day keeper's details appear on the V5 as registered keeper?

    If the PCN/NTK/NTH came via the lease co then it should have a copy of the lease details with it I believe in order for the scammers to transfer liability to the lessee.

    UKPC are BPA members, so you should be able to kill this at PoPLA.
