hello I was advised by a friend to post here and ask for some help about a problem I have.:money:

last month we had a work xmas party everything seemed to go well and I heard no problems about it. Apart from one guy got so drunk he was violently sick for 20-30 minutes. people had to assist him by giving him a box to be sick in because he couldnt make it to the toilet in time. :beer::beer:

now thats important because today i find out that i am suspended from work and will have disciplinary wednesday because this same person claims that whilst he was throwing up all over and i was kindly helping him, that i told him that my boss who is pregnant is a s*** who is pregnant by the area manager!:(:(

so first i was sent home from work without being given a formal letter stating i was suspended i was told that this letter will arrive to my home address monday. someone says that is not even legal?:cool:

second i want to ask is it possible that in my defence i say well this person was intoxicated and is not a viable witness? i was in shock today when i was told i said oh my god how can you believe this when he was so drunk he was sick?? the response was that he had eaten something funny and it wasnt the beer he didnt drink much! well i beg to differ to that age old excuse!:beer::beer:

    I so wish there was a restriction on the number of jumping smilies that are allowed in one post. They add very little value and detract from the content.
  • Did you say it? Interesting to note that your post doesn't actually deny that you made the comment. Are there any other witnesses than the vomiting man? If no, simply deny the allegation. "I completely refute that allegation and did not make those comments" End of.

    If, however, there are additional witnesses and you did say it, then the outcome might be very different and rightly so. It's a disgusting thing to say.

    If you want legal advice please see a lawyer - many do free 15/ 30 minute initial consultations.

    Q1) As above - did you do it? Are you known as an work place gossip?

    Q2) Did you take a blood sample from the colleague or breathalyze him? No? Then you have no PROOF they were drunk. many medical conditions can mimic the effects of alcohol, e.g. very low blood sugar.

    Q3) Has there been an investigation meeting before the disciplinary meeting?

    So at the moment you've been suspended based on an allegation that you haven't denied and your defence is the person making the allegation was intoxicated so is not a reliable witness. But management believe he is reliable enough to take his allegation seriously. You've posted plenty about your "drunk" colleague in just a single post.

    I have a feeling i know why management are taking it seriously.

    Why would you think this is not "legal"? I see nothing wrong with the procedure.

    I would be very careful with that "defence"! Remember, this is not a criminal court, the employer does not need proof, only a "reasonable belief" of your misconduct.

    Finally, regardless of the rights and wrongs, I would suggest that you take a far more serious approach to this matter than the tone of your post and the excessive emojis would suggest!

    i come to a place to ask for advice about a matter like this and it seems a bunch of people want to come on and attack me rather than help what wonderful people. some people can do better with their time than come to threads and type comments like this adding no help and just criticising. though seeing your other comments seems like this is your hobby

    i didnt realise i had to come here and post I AM INNOCENT I DID NOT DO IT. of course im innocent of it and no this isnt my full proper name, jesus. i stay out of the way of management i dont know them well and ive never had a conversation with area manager i see him very little i dont know where this comes from.

    to answer questions though to people that did reply to help. there are not other alleged witnesses just him they showed me a statement saying that whilst being sick i said it for some reason?

    sure low blood sugar that just happened whilst he was a party drinking alcohol not heard that before everyone always has an excuse its never for the drink. there has to be a standard adopted to whether someone is a credible witness id say that throwing up violantly is a standard for drunkness (ive seen enough drunk people) to think in qualifies apart from a blood test

    I can't see where anyone is attacking you. You wanted advice and you got it - it may not be what you want to hear but it is the line that any disciplinary will also be considering.
    I understand that you're stressed but if you fly off the handle like this in real life/the workplace you won't be doing yourself any favours at all.

    Are you in a union and have you sought their advice as some of what you seem to have been told is incorrect. Sending you home with a follow up letter is perfectly legal, for example.

    Is there any reason/past history as to why this person may be saying this, or any previous issues between your and yoiur boss?
    The disciplinary only needs to have a reasonable belief that the allegation is correct so background and context may be relevant.

    Is Wednesday an investigation meeting or a formal disciplinary process? Have you been given copies of your company discliplinary procedure so you know what your rights are and how the process will take place? If not, then you need to get them.

    The chances are he was drunk BUT as others have posted you have no proof of this, so stay away from assumptions and stick to the facts.


    Just tell the truth, you were helping him as he was being sick. If asked you can say you thought he was drunk at the time but also appreciate that this may not have been the case as people can be sick for other reasons. However I would only mention the fact you though he was drunk if asked.
  • it feels like being attacked people coming on to a message board and making out that im guilty for something because in a post i did not state clear enough i was innocent its like wow, maybe have some benefit of the doubt? and im not flying off any handle either.

    ive never had any history of anything i do not get involved in social occastions at work do not see anyone outside work im a bit of a loner i go to work get my head done and leave. i am not important enough to have history with anyone i go to work and do what im told and if i dont im sacked. the person in question this is really the second time i ever saw him.

    people at the time was saying how drunk he was and some sat on his table saying he drank alot and when i went back to work they said he was the only one hammered.

    so i can ask them all to do witness statements saying he was very drunk and that i have never said anything gossip like to them about this or anything else they have already told me they will do that but no past history between us
