and as was said on this morning these aren’t enforceable by law and you don’t have to pay
And who gave you that sage advice - Schofield, Willoughby, Holmes or Langsford?
now had Gladstone solicitors contact me
Really? By letter? Are you sure it's from Gladstones?

To whom does the letter ask you to pay the charge? £160 is it?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Read what an MP had to say recently about Smart Parking in the House of Commons.

    Pete Wishart (SNP, Perth):

"I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.

The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices."

Why not complain to your own MP?
You never know how far you can go until you go too far.
  • Maybe instead of being snarky if you’re not going to answer the question with some good knowledge then don’t comment and actually it was Martin Lewis when he made a statement about the difference between a penalty charge notice a parking charge notice

I was pointing out that no one should believe the stuff they see/hear on TV without further checking it out with experts.

I do come here with very good knowledge, thank you. But if Martin Lewis said that, it must be right then. I disagree with him (probably as do the thousands of people each year now being taken to court by private parking companies), but then I'm not a TV celebrity and don't have his dosh!

The remainder of my first post was a very serious set of questions which you seem to have overlooked in your haste to be offended.

Answer them now, then we can put you back on track.

Alternatively, if you want no more of my input, just let me know, happy to oblige whichever way you wish.

Smart Parking are very easy to beat at POPLA, and you simply need to follow the templates from the NEWBIES thread and not say who was driving.

    You then win at POPLA.

Smart don't sue people (yet) but get it killed off at POPLA. No need for threads about Smart, as these are so easily handled just by using the sticky thread template.
