I've written the letters (CCA and CPR 31.14) and I'll send them on Monday (registered post).
I wonder if they've lost the original Agreement, because they didn't send it previously when I asked for documents. The bank I temp for loses documents sometimes, I bet most companies do. Anyway, I'll find out soon.
I'm feeling a lot better now thanks to all the great help on here! You really are doing a great work for people like me who just don't have the knowledge or experience to deal with these things.0 -

The solicitors have put everything on hold until they can get the Agreement from the DCA. If they can find it this shouldn’t take long - they’re in the same building(!)0 -

The legalbeagles link said they have 12 days...
“A creditor must provide a copy of the agreement on request within 12 working days, or he becomes unable to enforce the agreement while his default continues.”
Is this for a different situation?

No, same situation, but there just guidelines, the 12 day timeframe is not set in stone, it’s just after 12 days, it becomes unenforceable until they do respond to you, however long that may be.
As I said, expect to wait a good few months until, or if, it’s found.

I got a letter on Saturday saying they can’t find the Agreement. I still owe the money etc. Nothing about the court case though.
It looks like I owe Sourcrates a big thank you!
