Ex husband was paid PPI on our joint mortgage

Please can anyone help or offer information

When I went to court to settle fiance about my divorce my solicitor found out my husband had claimed PPI on our joint mortgage. And had not disclosed this to me, she advice that I look in to this as it was a joint mortgage and we were both working when we took the mortgage out, and were told we had to have PPI in order to have the mortgage.

I have contacted Lloyds regarding this and they have confirmed they paid my ex husband PPI claim, but only sent it in his name? As the policy was just in his name, I said no that is wrong we both signed for the mortgage we both signed for the PPI as we were both working, so you still owe me my half of the PPI or my ex has received it fraudulently. She said they have paid my ex and as far as they were concerned the matter is closed? How can this be? We both signed for the mortgage, we both signed for the PPI as we were told that if one of us came out of work it would pay the mortgage. I remember it clearly.

Please someone help. :T

    Take your husband to the small claim court for your half. As your solicitor knew about it it should have been included as part of the divorce settlement I suggest. Do you know why it wasn't?

    Do you have proof it was in both your names?


    That will be key as the bank clearly believe it was not. I would strongly recommend you do not follow the advice above, the bank will not have paid out the money just on his say so, they will have paperwork showing it was just for him. You could try a SAR to the bank to see what documents they have but you're likely to be on a hiding to nothing unless you can prove it was joint (and no, your memory is not proof).

    It isnt the mortgage that matters. It is the MPPI that matters. If the MPPI policy had joint coverage then the redress should match the coverage. i.e. 50/50 25/75 or 0/100.

    Quite a lot of joint mortgages only had the MPPI in sole name. Usually to match the highest earner or if there was only one earner (i.e. 1 working and the spouse non-working).

    When I claimed PPI on an old mortgage in an exes name, I could only make a claim on half of the PPI, as I had to state the names on the mortgage account.

    Insurance regulation started in Jan 2005. So, anything from before that date may be little more than just an application form. If the policy ceased more than 6 years ago then they have destroyed what little they had.

    Send a SAR to see what info they used to decide why they paid it to him.
    However, if there is no record of you signing this MPPI agreement, they won't send it to you.
    It'll clear up what paperwork there was at least.
