Refusing to give PDT data

Options
Hi Forum,

In 2015 I parked in a car park and bought a ticket, this ticket was clearly displayed on my car dashboard, but I returned to a fine on my car.

At the time I ignored it, thinking there had been a mistake. (My mistake I know). I kept the ticket, but lost it during a house move a year ago.

I’ve since been following the newbie advice thread after receiving a LBC this year.

I requested a SAR from the parking company, but they are refusing to give me access to the PDT data information for the day in question that would prove I bought a ticket (a ticket that you can see blurred in their photo of my cars dashboard.)

The parking company’s reply has been

“Other queries such as requesting info on machine records and signage will need to be addressed to the debt recovery company chasing the unpaid PCN as this is not personal data.”

Is there anything I can do or argument I can make for getting the PDT data from the parking company?

ask for it again in any LBC rebuttal you make to any LBC that arrives, do a SAR on whoever sends the LBC as well

mention it in any defence and insist it is produced as evidence , which you should receive a few weeks before the court date

Who is the parking company ...... it's sounds like they actually don't have the info hence the refusual
  • It’s premier parking solutions.

I’ll do more reading on a LBC rebuttal. Does my Cars data not get covered by a SAR request generally? I thought it counted as a personal object?

you would have to ask the ICO, not us, this is not a legal forum, so try legal beagles for answers

the ICO dont come on these forums and are probably still finding their feet with the GDPR

if you are going to complain to the ICO, make it one of your points, then we may all learn something
