Over paid rent

Just wondering if any body has. had problems getting rent money back after family members die ?

What sort of tenancy was it?
As far as I'm aware the tenants estate remains liable for any rent until the tenancy is properly terminated.0 -

Think he means rent paid but deceased died before end date paid for.
Sheken you do realise (in England & Wales) that just because someone dies their tenancy does not end: The liability to pay rent, look after the place, continues and is responsibility of tenant's estate - usually their executors/relatives. But a kind landlord will be flexible. The estate needs to give notice to end tenancy.

Why was rent paid beyond the tenancy end date?
As explained, the tenancy does not end on the tenant's death. His executors/Administrators take over the tenancy and must either end it (according to the normal legal process), or continue to pay the rent and other outgoings (utilitoes etc).
Council tax can usually be claimed back - see the relevant local authority website for rules on CT on death of a sole resident (if someone else contnues to live there then obviously CT is still due).0
