How badly will a ccj affect my credit possibilities?

    It is possible to recall a decree but you only have 14 days after you have been served with either:
    • A 'charge to pay'
    • An 'arrestment' under diligence

    Finally someone who knows what they are talking about. The person who was surprised that gov(public) debt could be put onto a credit file was none other than Accountancy in Bankruptcy for Scotland, AIB.gov.uk.

    It's on my noodle as a county court judgement, I know in Scotland it's called a decree.

    Well I KNEW about the arrears and had arranged with my housing officer months before to pay a small amount each month, £15, her idea, I said I would pay around £80.

    Well she couldn't get in contact with me for weeks for a generally, 'whats going on chat' I probably changed my mob number but I'm in the flat all the time so she could have visited there is no way I would have missed her. Instead she decides to start the decree process for £645!!!

    I actually thought she was ok. What do you make of this???

    That's a tad embarrassing if the AiB accountant doesn't know social landlords in Scotland can seek a decree for rent arrears. Still nobody's perfect.

    Your housing officer sounds ok to me in that she agreed a payment plan with you. Did you make the £80 payments each month like you said you would or did you at least make the £15 payments?

    I recommend that before deciding on sequestration you contact the charity National Debtline for advice. Find out if the decree can be recalled and whether sequestration is the right option for you because there might be a better solution.

    As for the recall, I believe it's either 14 days or a month after it has been settled in court are you saying there's a possibility of a longer time span, it's been around 2 months now.

    No, I don't do this for a living. I helped my brother sort out his debts and he was also a council tenant in arrears. I'm not sure if there's a possibility of a longer time span. National Debtline should know though.

    I'm trying to find out if I can recall the decree but nobody knows, any idea how I would find this out?

    Contact the Scottish Courts and Tribunals or phone the Sheriff Court who issued the decree?

    I have contacted the courts they don't know.
  • I had a CCJ and i settled it within two months off it being placed agasint me. I found it near enough impossible to apply for credit within the first 2/3 years but after than i found i could apply for a credit card (high interest unfortunately) but that helped rebuild my credit so i could then apply and get a "normal" credit card

    I had one for a £100ish water bill (seriously), I was ill at the time it was sent and it just wasn't on my radar at all. By the time they added on court costs it had jumped to £189 (water companies shouldn't be allowed to do this really). I paid it off but my rating was shot to bits. Ratings don't matter though, only you can see them. I rebuilt my credit file, starting off with a mobile phone contract, then a credit card (massive interest rate though), and I did a BT to an interest free card a couple of years later. It takes time, just do your best to keep on top of things. I'm still waiting for a 'normal' credit card though, the only ones the free credit file sites offer are ones like Aqua or Capital One, which are credit building cards with high APRs. I haven't missed any payments in over 5 years, haven't gone over my limit etc so it's pretty annoying. The CCJ drops off in October so hopefully things will be different then.
