The Britannia/BWL axis is a pretty new arrangement. It seems that BWL have signed up lots of the hitherto court-reluctant PPCs (of which Britannia was one) and set up some deal with them to scoop up all previously ignored/unpaid parking tickets and threaten court action against the truculent motorists.

Effectively this is a debt collection procedure, but with a sting in the tail that an out and out debt beggar (DRP, ZZPS and the like) cannot deliver - court proceedings.

There will be large swathes of ignorers currently signing cheques to avoid being 'dragged to court' (a figment of their over-vivid and ill-researched imagination, preyed upon by BWL via the language and threats in their letters). 'Dragged' it is not. It is more a business type meeting between you, a rep of the PPC (sometimes they don't turn up) and a Judge to discuss the various issues and make a decision if anything is owing to the claimant.

I can't recall any Britannia case yet getting to the courtroom, but we are in the early stages of the BWL strategy. Britannia have always been, to me, a rather benign operator. Time will tell. Stick with us and keep us informed.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You really cannot just copy and paste. A lot of that is NOT DATA that you are entitled to under the DPA201, as it is not data relating to you
A sign? Not data relating to you
Whether they paid any debt collcetor? Not data relating to you.

    Split it out into
    Data that relates to you
    and
Data they hold that they are required to release under the pre-action protocol for debt claims, because it will narrow the topics under dispute. This includes....
  • Thank you for your advice, you've written this includes.... ? I think I will restructure and start again

Not wanting to derail this thread (and I'll be starting my own) but just for info Mrs Martmonk yesterday received a claim form, so the move towards court certainly seems more likely than before.

OP - yes, I said this includes with ellipsis, because you are then going to fill that out with the list of documents you want
Given it is everything that isnt data about you, then its a trivila list to construct.

Please read other Britannia 2017 claim threads. We can't keep repeating ourselves so I gave you the keywords to search, do start reading things like this:

    https://forums.moneysavingexpert.com/discussion/comment/75303959#Comment_75303959

Same as all the others and a keeper is not liable.

Don't forget that as part of the defence - and please don't reply to what I've just said before you read up on it on other threads first, as we do get overburdened here and are only a small 'team' of volunteers posting in our own time.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • I have re-structured my SAR and sent it, plus sent an email to BW legal stating this and asking to put my case on hold

I guess I now have to bide my time and wait, thanks for all your help
  • Am i right in saying I need to also send my defence to BW legal to rebut the original LOC?
