Developer needing access to my new home

    Check there is nothing in your deeds that does allow the developers access to properties until the developers/builders have completed and are off site. They may still have balls in their court.

    This is a picture of the illustration of the 2 garages on the right hand side of the picture. Access wouldnt be a problem once built for our neighbour but the builder to build the garage itself needs to dig for founds and remove my fence etc

    My initial thoughts were that you should try to get a very heavily discounted/free garage, but if that is what they are building then I wouldn't touch it with a bargepole. Because they have given each garage a conventional pitched roof running lengthwise it results in them having a completely unnecessary valley gutter on the boundary. That is a potential nightmare in terms of future maintenance.

    You should check your deeds to see whether you have a right to prevent them doing the work on your land or right up to the boundary. You should also check to see if there are any restrictive covenants preventing you from doing similar work in the future (or requiring you to pay them a 'fee' for permission). In the latter case you might want to think about asking them for some cash for the inconvenience, plus getting the restrictive covenants (in the developer's favour) removed.

    There is also the question of whether the developer is allowed to build a garage without getting planning consent. You might want to research that, as the answer will also be useful to you if you ever want to make changes yourself.

    Getting there some time, app they will be knocking down my fence i have currently and digging a few feet of my garden up
  • You need to check the location of the guttering. They can’t build right up to the boundary the guttering will be over your garden

    Looking at those pics, I would ask for a heavily discounted garage. I bet this was an optional extra you could chose during the building stages?

    It's probably too late for your neighbour to have a garage, and is probably resting on your decision as they probably insist on one.

    Regarding the central gutter, are any other garages like this (been built)? I would ask for one pitched roof, albeit at a lower angle across too garages.

    Get dimensions too, I'd want 3mtrs wide by 6mtrs long min.

    Also, electric? Make sure you get that, and with a decent amperage too!

    If you let them, and they build to the boundary it would be very difficult for you to build a garage in the future - remember their foundation would partially come onto your land.


    Edit: Just looking on the brochure, the garage is an optional extra. The planning will be satisfied, but I really wouldn't allow it without you getting a garage too.

    If you don't get a garage built at the same time, and you want to build a garage in the future you will have to have a gap due to the separate wall.
