Rent arrears court problem

That wasn't ever going to work I'm afraid...
I know health issues are problematic but this needs to be dealt with now. Do either of you have anyone who can help you with this - friend, other family member ... ? Sometimes just having someone there with you while you're filling forms, packing etc can go a long way.
I don't know if the council will help you - perhaps they won't count you as intentionally homeless as the rent is beyond your means? Regardless I think your best step is to ask, plus contact shelter as previously advised.0 -
Because of the various health problems in the family it might be possible to claim PIP etc. It might be worth a visit to the CAB to find out. However, it could take months to actually get with the appeals process and you'd need evidence of these difficulties. You may already be claiming for them.
Some councils will help in cases with rent arrears if you can prove that the rent was above what you could pay with the income you had. You could have applied for a discretionary housing payment.., I'm surprised this hasn't already been explored by your local housing department. Sometimes housing will agree to pay a portion of the areas off if the LL will let you stay. But of course, it depends on what the level of the arrears are. This, together with a payment plan to pay more rent might help.
I was paying £250 a month on rent on top of HLA. I just made it my first priority, it came before food, bills, everything. It is possible.
A lot of housing departments won't help until the bailiffs warrant has been served and you are out of the house. But you need to ask this of your housing department, not us, they know what they do. We don't. It depends on the borough's policies.
Be prepared, it can be a lot less than 'weeks', the LL can go to the High Court and get Sheriffs involved who can turn up with no further notice. Even bailiffs can be round within two weeks once the warrant has been given. Not all boroughs take weeks. You should be packing up and ready to go very soon. Just in case.
