How long am i being expected to wait for a sale of an additional property whilst still living in the

Hi

I have a dilemma wether to wait out for the sale of a house that is part of a court order or go back to court to review the issues of the sale.

I have being divorced from the ex since December 17, we went to court to settle the financial outcome of two properties and a small amount of savings.

The ex wanted to retain the marital home and the savings, I was happy for this to happen as long as she sold the second house quickly.I was also ordered to pay all of the household bills and a further contribution to the food costs until the property is sold. The other house had a probate price tag of £620.000 as stated in the court hearing.

It has now being 13 months since the court case was heard, the ex put the property on the market with an agent to the tune of £105K more than the probate value.needless to say there was no interest. Recent viewers of the property have complained on the room sizes and don't entirely like the road.

On several occasions through my solicitor I complained the value was too high and the property wouldn't be sold.The ex reluctantly dropped the price a couple of times.

Today we are now in the situation that the property is valued at below the probate value given a year ago. Meanwhile she has had tenants in the house and raking in an income of 14k which i have not seen a penny of this money.

Looking for a solution to assist the solicitor to get this matter resolved quickly as possible as my life has being on hold whilst still having to live separate lives in a separate room in the ex-marital home.

  • How come your ex is in charge of selling the second property and not you? Couldn't you agree for her to keep the martial home/savings and you have the second property?

    How much of the property were you supposed to get?

    A claim for a beneficial interest in the rental income might be worth a try.

    Selling with tenants in place is a very easy stalling tactic to put off any interest.

    I'd second requesting a share of income. Is there a mortgage? I ask because as well as being entitled to the income, you could also be liable if things are being done incorrectly, consent to let, insurance, tax, gas checks etc.

    Re your last paragraph, you say your looking for a solution to assist the solicitor to get the matter resolved quickly, is this not what your paying the solicitor to do ?
