Parking Charge Euro Car Parks Matalan

Hi,
I have received a PCN NTK through the post from Euro Car Parks for overstaying in a Matalan car park. The NTK came through within the 14 day window unfortunately.

I have read through the Newbie Thread and believe my first port of call is to complete the One size Fits All First Appeal with no admission as to the driver etc. I will pop back to the 'scene of the crime' tomorrow to check out the signage cameras etc.

I wonder how successful I am likely to be considering the car was there for over 4 hours while the store was closed; I had wrongly assumed, as had been the case quite a few years ago, that the car park was a shared resource with other local businesses, we were in the pub and then the restaurant across the road.

Any advice gratefully received.

    Send the blue text appeal as you plan to do.

    Send it unchanged - no additions or alterations necessary.

    Send it as the keeper.

    Check with the local council. The original planning consent for the car park will be crucial. You'd be surprised how many allow the use of the car park for shopping/use of other parts of the town.

    PPCs ignore, or are blissfully unaware (no excuse), in their desperate grasp for your coin.

  • Ok, I sent the blue text appeal as described in the newbie thread, I have had the Popla code through and responded to that shamelessly copying and editing one of the winning letters, mine was about 16 pages when complete.
    ECP have responded with what looks a standard report showing copies of the original letter pictures of the site etc. To be honest their evidence seems like a stock reply and does not really address some of the key points raised by myself.
    I have now responded with my comments emphasising the lack of clear image of the vehicle, signage lighting and ANPR issues.
    Can anyone advise how long it will now be before POPLA make a decision?

    There was a FOI request on the web regarding the shared use of the car park from another victim, the council have unfortunately confirmed that any existing agreement expired when the site changed over to Matalan from the previous residents. There is however no evidence of advertising or planning consent from the council so we will see how that goes with all the other evidence submitted.
