PCN - Court Claim issued - need help!

    I had told him not to talk to them so he just said as you are taking legal action against me I have no wish to talk to you - is this the correct advice?
    Yes, that's a good answer.

    If they try again, email them robustly and forbid them to use the phone number as it is causing harassment and distress. And he could throw in that it's not a secure or confidential way to contact him either, as a call out of the blue may be picked up by other family members, which he is sure a scam debt-chasing firm realises, is potentially a breach of data protection as well as a breach of debt collection guidelines.

    Companies with certain connections or reasons to have his data are allowed to do what's called a 'soft credit check', which doesn't affect his credit rating. For example, I had about half a dozen soft credit checks runs through on my credit record this past month according to Experian, all of which were labelled as insurance checks, and I hadn't made any applications to anyone whatsoever. It'll be because I probably did a Compare the Market quote around the same time of year, last year, or I've ticked a box years ago telling car insurers when my old car insurance was due. None of it matters, it has no effect and is allowed.

    Shame about the credit check - I think he was hoping he could take them to court ;)

    28 days for the Claimant to respond. Hoping they drop it!!


    I have a note in my calendar to chase up the SAR with NCP as that will be the basis of our evidence (ticket being paid but error on keypad) have read the next steps would be the questionnaire then witness statement.

    Need some advice on a response to the below, we have had the SAR back from NCP but all it shows is some photo's (that had already been sent) of the reg of the vehicle entering and exiting the car park on the ANPR camera's, they have stated the below to my request:




    Please find attached a copy of the information we hold regarding your request. This includes still images of the contravention.





    Please note that a subject access request only entitles you to:


    • information about you
    • that the organisation holds


    For the aforementioned mentioned reasons we cannot disclose (or you are not legally entitled to) the below information via a SAR:


    • Close up of the signs on the day in question (not personal data)
    • Evidence that a debt collector has been paid (not personal data)
    • Record of the Pay and Display machine from the day in question of payments made (not personal identifiable data relating to you)


    If you feel that the company’s actions have fallen short of your expectations, then you can contact the Information Commissioner to highlight your concerns.







    This doesn't include payment information which we feel would help identify that a ticket was paid for, and that the ticket machine was faulty ;) which is kind of our main defence.


    Can I pursue this further to try and get that information as I feel without that it really weakens a defence?

    Yes it does - the payment relating to your VRN, does relate to you as your VRN and payment are your personal information. INSIST.

    Obviously pics of signs are not personal data, nor is evidence that a debt collector was paid. But the former is evidence they will have to show later, with their WS they will have to show pics of the signs, and the latter is a figment of their imagination anyway - they cannot add £60 even if they bleat about it.

    Long story short they woudn't give up any details of VRN, then they sent through the evidence they were going to provide the court and they had the wrong date of offence - it was a year after the parking charge was issued. Dad went to court on the day, and after a delay, them making him a final offer to pay before going in he went in, pointed this error our to the judge and the case was dismissed!


    Don't let these scumbags bully you!!!
