any help please

hi,
2 weeks ago i bought for £56 a six pack of dog flea treatment from jolleys pet store i've used one and at advised frequency of useage at 1 per month it will take me until july 2019 to use up pack of 6,the problem is the use by date is end of march 2019 which i didn't read until after i'd used first flea treatment,i've not contacted store yet but want to know my rights prior to 1st contact,

additional points are 1.i've contacted the manufacturers of flea treatment and they've advised me not to use beyond march 2019.
2.item was in a locked display cabinet within store and had to be signed for
3.paid via c.card

any help appreciated please

    Purchase date = 15th December


    First use = 16th December


    Use 2 = 13th Jan


    Use 3 = 10th Feb


    Use 4 = 10th March


    Aside from the fact that you could have 2+ dogs (which is actually a legitimate point, though the company didn't know when contracting so it is a pointless point), this does appear that you'll be losing out on 2/6 of the uses.


    I think that you have a good shout to argue that the item is not fit for purpose (to provide 6x treatments based on the specified 4 week timeframe). The company should therefore either:


    - Replace the items (2x packs) at no cost to you


    - Refund you to reflect the missing packs (in this case 56/6*2 = £18.67


    They'll be able to choose the remedy.


    I would start by pointing this out POLITELY to them and hope that you can either get the 2x packs or the £18.67 refund with minimal hassle. Taking pictures of the "use by" date would help too, as well as correspondence from the manufacturer themselves. I place emphasis on "POLITELY" because, if you get their backs up, they may refuse and taking them to court would be a right pain in the neck here.

    Scroll down towards the bottom of the link and it's says it's illegal to sell out of date products - not read it carefully enough to check it applies to what you e bought though.

    If it's only a couple of months out I'd probably still use it. The efficacy may be slightly reduced but it's not going to turn toxic overnight.

    If you had taken time to read it, you'd know it's not out of date yet, but the full course of treatment will not be able to be used before it goes out of date and the OP has been told the treatment should not be used after it's date of use!

    I did take the time to read it, thank you.
    I was working on the basis that if the treatment couldn't be used in the timeframe needed and came in a pack of 6 the argument could still be applied.

    And as to the manufacturers comment, to misquote someone else "well they would say that, wouldn't they." I've used more out of date meds for myself more than once - depends what it is. Heart meds (for example) where you want to be sure of the full dose, nope, painkillers yes. For me, flea treatments would fall into the second category. If the OP is not able to get them changed.

    But it's not an out of date product so there's nothing illegal about selling it. It's probably not fit for purpose, but implying to the OP that they might be able to argue it's an illegal sale is daft, and ultimately pointless as the store will know that.
  • thankyou all for your assistance,i shall be contacting store this week and will post outcome,as i will probably use flea treatment every 6 weeks this will probably make 3 of the 6 unusable so the loss is probably going to be £30 not going to change the world but very annoying i will be strongly using the not fit for purpose line,

  • final update,i decided against just going into store of purchase initially so i rang the head office and there was an immediate agreement i should have never been sold pack of 6 i was offered half the money back and retain the 3 useable tablets this agreement was then emailed to my local jolleys store.
    This approach was just as well as the staff went into melt down when i visited local store and explained situation so it was just as well i had a prior agreement with a more senior member of staff at head office thanks again for all previous help
