    Just a quick update - no news from Virgin Money, so I decided to do a balance transfer. I understand that by doing this I am not accepting liability.

    Just wondering now if there any time scale for S75 claims?
  • Card issuers may have internal timescales but I don’t believe they are under external timescales like they are with complaints (8 weeks).

    Essentially they can take as long as they like. Ultimately if you win you could claim interest, but that would be very small.

    Since S75 creates a legal liability on the lender, you are always free to sue the CC. You shouldn't do this without warning them first. Once you do, then it will be the court that governs the procedure, not the CC.

    Always good conduct to try and settle things amicably first - and that includes following internal procedures and/or complaints procedures. But I wouldn't hesitate if they drag their heals.

    Update.

    About a year and a half later after submitting the claim, a number of chasing-up phone calls and several letters with supporting evidence, I have received a settlement letter from Virgin Money, which I accepted. My CC balance has been cleared in January 2019 and now is showing as negative.

    I wonder whether I should call them now and request to transfer the funds to my bank account or wait for a couple of months? Is there any possibility that VM/the retailer will request the funds to be returned?

    If it's a S75 claim, then you should have received a letter stating that it is a full and final settlement.
    S75 comes from card provider, not retailer.
    As such you are free to call and get the funds transferred back to your bank account free of charge.

    Thanks - I believe it was a confusion between S75 and chargeback (the latter the retailer can dispute, of course).

    Looking back at the previous posts. This is not a chargeback. Due to your previous posts being over a year ago.
    If a chargeback was actioned the retailer only has 45 days to contest. They can look at a good will option after that, within I think its a further 28 days. But a card provider does not have to agree. They would normally contact you 1st to see if the reason they came back late was OK with you. Something like they had refunded in the mean time.
    So no reason the retailer will come back. As a said. S75 is paid by card provider. But they could (read never do) chase retailer. As it is not cost effective.
    Again this has nothing to worry you.
    Call and get the funds back in your bank account.
