Debt Collectors forcing me into CCJ

Options
Apologies if In wrong thread.

Background (I know I have been screwed over in first place but sort of a bigger issue to deal with before contacting them) Took out a quickquid payday loan in 2014. They offered me to keep extending extending till I couldn’t manage it. Defaulted - set up a payment plan via CPA they started taking money outside payment terms complained to QQ and Bank - Bank in error refunded all payments made to them. They automatically sold debt to Moriarty law, where all of this goes further south. I had moved abroad.

Moriarty law did the very minimal to trace me aside of sending letters to same address before taking out a CCJ
I found out about a month after they applied for it contacted them to set up a payment plan everything to their choosing (their terms non negotiable payment dates amounts etc) every time I said I cannot do it they straight away would just tell me they will take this to court.

Anyway i made several payments and then I had issues with my card and a payment wasn’t made. As I couldn’t get through to them when I tried to ring I sent them an email, they ignored it. They then sent me auto email saying they want to talk to me I can either reply to the email or phone them. I replied telling them to take the payment again. Again ignored.
The payments they wanted me to make were £178
They then sent me this on 21st December (9 days later) on the back of the email to take the payment saying the following:

Thank you for your email.

A Judgment was issued on the 19/01/219 due to non payment., and you are ordered by the courts to make payments of £25.00 a month from 19/01/2019 and on the 19th of the month thereafter.

Please call out offices on 0203 126 4544 to discuss this account further.

I have checked and they have issued the CCJ on 20th December.

I just don’t understand where the hell the £25 From and how is it ok for them to ignore emails when they know I cannot call them.
How could they have made any agreements with courts when the payment missed was on 30/11.

Email has completely wrong dates and I think the info about ordered payments and amounts is bull. What can I do about their actions? Have they acted illegally?

I will pay off the CCJ within a month so that’s not the issue I just don’t want to let them get away with such practices.

  • It’s not the lenders or DCA to chase or track you down when you move, especially abroad. You should have updated them with your new address details.

Why is it you can't call them ?

Im not sure they have done anything illegal.
  • They can't force you into a CCJ. Only if you don't make payment and a court awards one, can you get a CCJ, which seems to be what had happened here.

The £25 payment will have come from the court judgement.

Have you checked your credit files to confirm the CCJ?

If you're able to pay it, then do so.

Are you returning to the U.K. in the next six years? If not, don't sweat it.
  • Please stop advising people to ignore debts. It’s not the moral thing to do.

Payments were missed and the CCJ awarded - if the debt can be fully cleared within one month then do that to get it off your files and learn from your mistakes.
  • I am back in a week it was a short term 4 months work trip.

It will be paid off, the issue is their approach I do not want them to get away with it I just want to know if there is something I can do.

  • Ok just quick few points.
    1) This will be paid off it’s not the issue
    2) I just want to know how the £25 a month came about. They have lied to me throughout and I don’t believe this either.
    3) Can they ignore communication and just simply take out a CCJ especially when I am giving them instructions to charge my card
  • It’ll be a court charge.

Just pay it and move on.

Stop looking for compo or something that doesn’t exist
