    Its not exactly clear what grandad's Will resulted in? Was everything left to grandma absolutely or was some kind of trust set up? Its also not clear what you mean by 'admin for the estate'? Since your grandad had a Will, that Will would have named executor(s) and ,if appropriate, trustees.

    Thank you for your response. In the will it says if my wife passed away within 30 days of my death it then goes to (my mum) & (my uncle) in equal shares but if she did survive for longer it goes to my wife unless she renounces probate and no longer wishes to be an executor in turn it will be handed to my trustees my mum & uncle to be trustees and executors.

    This then went to probate after my grandad had passed away due to her not being capable of being an executor so when in court they made my uncle the administrator of the estate use in benefit of my grandma.

    This all seems very confused. If the will was admitted to probate then it WILL be on the government index and a certified copy is available to download fo £10 fee. Have you double checked the index? That has to be the starting point. Anything also is just speculation. You need facts! Then we should be able to help you.

    [FONT=Verdana, sans-serif]From what you say it sounds literally like you grandma could renounce her inheritance, not probate, and if she did not wish to be executor of grandad's Will then son and daughter would be executor. But maybe you are just referring to renouncing being executor, I think that is much more likely?[/FONT]

    Yes I have the will and the grant it says on the will that if say grandma renounces herself from the will then my mum and uncle both become the trustees and executors. My grandma did do that after he had passed then the court made my uncle the admin of the estate but only for the benefit of my grandma unbeknown to us.

    The will did state that if she was to pass within 30 days of his death then my mum and uncle would both inherit equal shares.

    Are those are the actual words in the Will? Can you quote what the Will actually says except names. I think you are trying to give a summary of the Will which makes it very difficult for people to comment.
