Appealed but no response

I received a NTK from Future Parking in October, fining me for parking but not paying. However, I actually didn't park, I'd been waiting for a car parking space and when I couldn't get one after waiting sometime I drove out the car park. This is where the cameras at the entrance has logged me as not paying for the duration.

I complained to the company that owns the land, this didn't go down well and I was met with very unprofessional manner from the owner, so I then appealed on the 8th October (and received confirmation of receipt).

Future Parking still sent me letters asking for payment and today I have received a debt letter. I've had no response to my appeal, I'm assuming this is incorrect procedure?

I've tried to look into posts but haven't come across a similar situation, please do let me know if you know of a thread.

So, I'm wondering what my next steps should be? Do I need to leave it as I've done my part, or do I need to get in contact with Future Parking or even POPLA?

Complain to the BPA that the PPC is denying your right to ADR by their non-response to your appeal, with no POPLA Code forthcoming.

Tell them they have referred your case to debt collectors when the appeals process hasn't yet been concluded - contrary to the requirements in the BPA Code of Practice. Copy the BPA in on any paperwork already exchanged with the PPC (especially the receipt for your appeal) and with the debt collector.

complain to the AOS at the BPA asap, with a brief timeline and copies of all paperwork etc
  • Thanks very much everyone! I’ll make sure to do this.

Umkomaas, thank you very much for all that info! Would you say the email you’ve copied to be the best person to contact at the BPA?

Twhitehousescat, I felt like the company is pretty fishy tbh, when I checked they didn’t have a working website and I’d never come across them in any searches.

Umkomaas would not have suggested it if he didnt think it was best and it always has been for over 6 years

if you go to the BPA website and look at their AOS members, you can click on their website link and see the actual website and read the ABOUT US page

its clear that this is the fledgling business of the son
  • Thank you Redx, I'd assumed so, but just wanted to double check as when I did go to the BPA website there was a couple of ways to contact and did not include this direct email.

I see LPS ltd has a working website, Future Parking does not.

You guys are great, thanks again for all the advice!

    and complain to your MP

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
You never know how far you can go until you go too far.
